Terms & Conditions
1. Definitions
“Trip” means any travel itinerary, package, service, or component arranged by Naamaya.
“Supplier(s)” means independent third parties providing transportation, accommodation, tours, activities, guides, meals, insurance, or other services.
“Force Majeure” means events beyond Naamaya’s reasonable control, including without limitation: acts of God (for example flood, earthquake, storm, or fire), epidemics or pandemics, public-health emergencies, governmental acts or advisories, closures or travel bans, war, riot, civil unrest, terrorism or credible threats thereof, strikes or labor disputes, infrastructure failure, flight, ferry, or train cancellations or delays, hotel or carrier overbooking, road closures or unsafe conditions, environmental hazards, and any similar or supervening events.
2. Formation of Contract & Acceptance of Terms
These Terms govern all bookings with Naamaya and form a binding contract upon your registration and/or payment for any Trip.
By booking on behalf of others, you represent that you are authorized to accept these Terms on behalf of each Traveler and that each Traveler meets the requirements of participation.
No claim will be accepted that the Traveler did not read or understand these Terms prior to booking and/or participation.
3. Registration & Payment
3.1. Digital Quote, Online Registration & E-Signature. Naamaya may issue a digital quotation or itinerary (“Digital Quote”). Registration is completed via a secure online link where the Traveler: (a) reviews and accepts the Digital Quote and these Terms; (b) selects options or add-ons; (c) provides Traveler details including full legal names exactly as shown on passport, including any middle names, date of birth, nationality, passport number and expiry, and sex as stated on passport; (d) uploads clear color scans or photos of passports showing at least six (6) months’ validity beyond the planned return date; (e) provides emergency contact and relevant medical or dietary notes; (f) e-signs the booking form and any required supplier waivers; and (g) pays the required deposit. Electronic signatures and records are accepted by the parties as legally valid to the maximum extent permitted by law.
3.2. Booking Confirmation. A booking becomes confirmed only upon Naamaya’s written confirmation of services after receipt of the required deposit and Traveler details. Quotations are not a guarantee of availability or price until confirmed. Incomplete or inaccurate information may delay confirmation; Naamaya is not responsible for resulting costs or loss of availability.
3.3. Deposit. Unless otherwise specified in the Trip materials, a deposit of USD 800 per person is due at registration and applied to the final balance. Deposit refunds, whether full or partial, will be made in accordance with the Cancellation & Refunds policy in these Terms, calculated based on the date Naamaya receives your written cancellation. Naamaya may deduct non-recoverable supplier charges already paid or committed and reasonable administrative fees. Certain itineraries may require a higher deposit due to internal ticketing, cruises, rail, special permits, or supplier policies; such requirements supersede this clause.
3.4. Final Payment. Full payment is due no later than 45 days prior to the Trip start. Some Trips require earlier payment due to airline ticketing, vessels, trains, special services, or hotel terms. If payment is not received by the due date, Naamaya may cancel your booking without further notice.
3.5. Payment Methods & Timing. Payments must be made in the quoted currency unless otherwise agreed in writing. If payment is made in another currency, the amount received by Naamaya must equal the invoiced total after conversion and any bank, wire, or merchant fees. For bank transfers, the applicable exchange rate is the rate applied by the receiving bank or payment processor on the date funds are received. For installment payments, each installment is calculated on the date received.
3.6. Chargebacks. You agree not to initiate credit card chargebacks or payment disputes except in cases of actual fraud. Unwarranted chargebacks will be contested and may incur administrative fees and recovery costs.
4. Pricing, Currency & Taxes
Prices provided in sample itineraries are indicative only and may change based on travel dates and live supplier costs.
Trip prices are based on international and local supplier rates, taxes, fees, surcharges, and foreign exchange. Any changes to these inputs, including airline fuel surcharges, airport taxes, and currency fluctuations, may adjust the final price and are payable by the Traveler.
Prices are quoted in USD, AUD, NZD, or EUR depending on destination. Payment must be made in the quoted currency unless otherwise agreed in writing; if another currency is used, the amount received must equal the invoiced total after conversion and fees.
Unless explicitly included, airport taxes, security surcharges, and newly imposed government fees or taxes are not included and will be collected as required by the issuing carrier or authority.
No set-off; refunds net of costs. All payments must be made in full without set-off, counterclaim, or withholding. Any refunds issued by Naamaya will be net of non-recoverable fees and losses, including bank or merchant charges, wire fees, and currency conversion losses.
5. What the Price Typically Includes
The specific inclusions stated in your itinerary, Digital Quote, and booking confirmation govern. If there is any discrepancy between those documents and the generic list below, the itinerary or Digital Quote controls.
Accommodation: As specified, hotel, lodge, or camp category, twin or double with private facilities unless stated otherwise.
Guiding: Local English-speaking guides unless otherwise detailed; some destinations use shared international tours.
Meals: As specified.
Transportation: Private or shared tourist vehicle as per itinerary; not at free disposal beyond program.
Entrance Fees: As specified for listed sites and reserves.
Tips: For escorted groups, typically included and distributed by the guide; for private or independent arrangements, payable locally.
6. What the Price Does Not Include
The exclusions set out in your itinerary, Digital Quote, and booking confirmation govern. Items not expressly listed as included are excluded.
Passports & Visas: Fees and processing.
International and domestic flights.
Taxes & Surcharges: Airport or security taxes unless specified; newly imposed government charges.
Meals & Beverages: Unless expressly included.
Insurance: Mandatory travel insurance is purchased separately by Traveler, including baggage and personal-effects coverage.
Optional Tours/Activities: Items not listed in “Includes.”
Personal Expenses: Laundry, phone, mini-bar, spa, incidentals, and similar items.
7. Gratuities (Tips)
For escorted group tours with a lead guide, required tips are typically collected prior to departure and distributed to relevant Suppliers, such as drivers, waitstaff, hotel staff, and local guides, by the guide.
For private or independent arrangements, Travelers tip Suppliers directly, guided by customary local practice.
8. Amendments, Cancellations & Refunds
8.1. Consumer Protection. Certain consumer-protection statutes may apply to international air segments depending on the country of booking and departure. Ground services provided outside the country of booking are governed by Supplier terms and are generally outside the scope of such statutes.
8.2. Traveler Cancellations (Ground Services). Unless otherwise stated in trip-specific notes or supplier terms, the following fees apply to ground arrangements: up to 45 days before departure – USD/EUR 150 per traveler; 44-30 days – 30% of Trip price; 29-14 days – 65% of Trip price; 13-7 days – 75% of Trip price; 6-2 days – 90% of Trip price; later, no-show, or day of departure – 95-100% of Trip price.
8.3. Special Destinations/Seasons. During peak seasons, holidays, local peak periods, certain permits, Galapagos cruises, and similar products, full or exceptional cancellation fees may apply from booking or confirmation.
8.4. Flights. International flight cancellations are per airline fare rules plus a ticketing fee, typically USD 40 per ticket. Domestic flights are generally 100% non-refundable after ticketing.
8.5. Refunds & Credits After Cancellation. If funds have already been remitted to Suppliers, any refund will depend on those Suppliers’ policies and timelines. Where lenient terms are obtained, refunds may be processed after funds are returned or the services are reused by others. In some cases, a future travel credit may be offered in lieu of refunds.
8.6. Partial/Unutilized Services. Once travel commences, unused services are non-refundable, including missed tours, segments, meals, and nights.
8.7. Operator Cancellation. Naamaya may cancel a Trip for any reason up to 15 days before start, including insufficient enrollment. Payments received will be refunded within 30 days of cancellation, consistent with the payment method used. No additional compensation is due.
8.8. Change Requests. Post-booking change requests are subject to availability, Supplier approval, and change fees.
8.9. Written Notice. Cancellation or change requests must be submitted in writing by email and are effective on the business day received, Monday-Friday, excluding public holidays.
8.10. Minimum Group Size / Guaranteed Departures. For escorted group tours, operation may be subject to a published minimum number of participants. If the minimum is not met, Naamaya may cancel the group with a refund per 8.7 or offer alternatives, such as operating with fewer participants at a supplement or converting to a private arrangement.
9. Credits, Vouchers & Non-Transferability
Any credits or vouchers issued are non-transferable, non-refundable, and subject to expiration and blackout dates, unless otherwise stated in writing.
Credits may be limited to specific destinations or Suppliers.
10. Naamaya’s Role & Third-Party Suppliers
Naamaya organizes and coordinates travel services on your behalf. We are not an airline, hotel, carrier, or local operator; we work with independent Suppliers who are not employees, agents, or partners of Naamaya.
Naamaya is not responsible for acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
Each Supplier’s own terms, conditions, waivers, schedules, and policies apply and may limit or exclude liability. You must comply with such Supplier terms.
If a Supplier cannot provide a confirmed service, such as due to overbooking, Naamaya may arrange a comparable alternative where reasonably possible.
If a Supplier becomes insolvent, suspends operations, or fails to perform, Naamaya is not responsible for resulting losses. We will make reasonable efforts to assist with alternatives or documentation for insurance or chargeback claims. Additional costs required to continue travel are the Traveler’s responsibility.
Activities or services booked directly by the Traveler with third parties, including those recommended by a guide or hotel, are outside your contract with Naamaya. We bear no responsibility for such services.
11. Supplier- and Destination-Specific Addenda
Certain destinations and Suppliers, including expedition vessels, rail journeys, national parks, high-altitude treks, and dive operations, impose additional waivers and terms. These are incorporated by reference and provided at or before booking; your participation constitutes acceptance.
Where an addendum conflicts with these Terms and is expressly stated to prevail, the addendum shall control for that service.
12. Force Majeure & Changes Beyond Control
12.1. No Liability for Force Majeure. Naamaya is not liable for failure or delay in performance due to Force Majeure.
12.2. Operational Flexibility. Naamaya and/or Suppliers may modify routes, schedules, accommodations, or services where necessary. We will make reasonable efforts to assist and minimize disruption.
12.3. Additional Costs. Any additional costs arising from Force Majeure or changes beyond our control, such as extra nights, re-routing, private transfers, re-ticketing, fare differences, carrier-imposed schedule changes, aircraft swaps, or inventory controls, are borne by the Traveler, though we will strive to help identify reasonable options.
12.4. Force Majeure – Cost Allocation & Health Measures. Without limiting the above, Travelers are responsible for costs arising from: (a) additional accommodation or meals due to delays or cancellations; (b) re-routing or alternative transportation, including re-ticketing and fare differences required by carriers; (c) government-mandated health measures such as testing, vaccination documentation, quarantine or isolation, and masks or PPE; (d) border closures or sudden regulatory changes; (e) required travel documentation updates such as passports, visas, and permits; (f) supplier-driven operational decisions and constraints by large service providers we rely upon, such as airline retimings, cancellations, overbooking, crew legality issues, air-traffic control restrictions, aircraft substitutions, system outages, or service withdrawals, that necessitate changes to the itinerary; and (g) insurance updates or policy adjustments required by carriers, destinations, or regulators to continue travel.
12.5. Pandemics & Public Health Events. Services may be altered, reduced, or withdrawn to comply with public-health guidance. Failure to comply with health requirements may result in denial of service without refund.
12.6. Carrier/Operator Changes Not a Breach. Carrier or operator actions described above, including schedule changes, cancellations, retimings, aircraft substitutions, overbooking, and revalidation or reissuance requirements, do not constitute a breach by Naamaya. Your contract for carriage is with the carrier per Section 8; Naamaya acts as organizer or agent. We will assist with rebooking within carrier rules where possible, but any additional costs, including extra nights, meals, re-ticketing fees, private transfers, and fare differences, remain the Traveler’s responsibility.
12.7. Exceptional Events, Airspace Closures & Inability to Travel.
In recent years, the world and our region have experienced exceptional and unforeseen events, including but not limited to extreme weather conditions, natural events, pandemics, strikes, widespread flight disruptions, travel restrictions, government decisions, airspace closures, airport shutdowns, security situations, wars, or any other circumstances beyond the control of Naamaya or the Traveler, which may prevent the Trip from taking place as planned.
In such circumstances, Naamaya will act in good faith and will make every effort to work with local Suppliers, airlines (if flights were booked through us), and other service providers in order to secure the most favorable possible arrangements under the circumstances. This may include reducing cancellation fees, rescheduling services, postponing travel, obtaining future travel credits, or identifying alternative solutions, where feasible and subject to availability.
However, all cancellation, amendment, and refund terms are determined solely by the relevant Suppliers and may not take such events into consideration. Accordingly, even where the Trip cannot be taken, completed, or continued, full or partial cancellation fees may apply, or a credit may be offered in lieu of a monetary refund.
The Traveler acknowledges and agrees that the financial risk arising from cancellation, delay, modification, or non-performance of the Trip due to such events may rest with the Traveler, in whole or in part, in accordance with Supplier terms.
In the event that the Traveler is unable to depart, continue the Trip, or return to their home country as scheduled, any additional costs incurred — including but not limited to extra accommodation, alternative or evacuation flights, extended ground services, transfers, meals, or any other related expenses — shall be borne solely by the Traveler. Naamaya will assist, to the fullest extent possible, in coordinating alternative arrangements, but shall not be responsible or liable for such costs.
Naamaya does not guarantee the ability to obtain refunds, credits, or waivers of cancellation fees under such circumstances, but will continue to act in good faith in an effort to minimize costs where possible.
Naamaya shall not be liable for any loss, damage, expense, or inconvenience arising from such events, including but not limited to cancellation, delay, modification, or curtailment of the Trip.
By booking or participating in a Trip, the Traveler acknowledges that international travel, particularly to remote destinations, involves inherent uncertainty and risks beyond Naamaya’s control, and accepts the potential financial and operational implications described above.
Travelers are strongly advised to purchase comprehensive travel insurance, including coverage for cancellation, trip interruption, delays, and emergency expenses.
13. Traveler Responsibility, Health & Conduct
13.1. Fitness to Travel. You must be physically and mentally fit to undertake the Trip. You must disclose any medical condition, disability, mobility limitation, allergy, or dietary requirement at registration so we can assess feasibility. Naamaya may decline participation if safety or feasibility is compromised. By registering for and/or participating in the Trip, you acknowledge that you are solely responsible for your own decisions, safety, health, conduct, and property throughout the Trip, and you agree to exercise prudent judgment and comply with all instructions and applicable laws.
13.2. Compliance & Safety. You agree to comply with all safety instructions from guides, drivers, and Suppliers; to wear seatbelts when available; and to use appropriate safety equipment during activities.
13.3. Assumption of Risk. By selecting a destination, you acknowledge the inherent risks associated with travel and accept personal responsibility for traveling there, including remote areas and developing regions where medical facilities and infrastructure may be limited. Risks include, without limitation, illness, including communicable or infectious disease, injury, or death caused by forces of nature, terrain, wildlife, weather and environmental conditions, transportation incidents, or negligent, willful, or criminal acts of third parties or terrorism. Medical services may be unavailable, delayed, or below the standards of your home country.
13.4. Travel Advisories. Governments issue advisories. It is your responsibility to stay informed and make decisions accordingly.
13.5. Behavior. Naamaya may remove any Traveler from a Trip at its sole discretion for unsafe, disruptive, illegal, or offensive conduct, without refund and with liability for resulting costs.
13.6. Minors. Travelers under 18 must be accompanied by a parent or guardian who assumes full responsibility and signs all required documents. Rooming policies vary by destination and hotel.
13.7. Prohibited Items. You are responsible for compliance with all customs, import/export, aviation or airport security, and transport regulations, as well as airline conditions of carriage, including dangerous-goods rules, lithium-battery restrictions, hazardous materials, and baggage size or weight limits. Failure to comply may result in confiscation, fines or penalties, denied boarding, refusal of carriage, or detention; all related costs and consequences are the Traveler’s responsibility.
13.8. Traveler Conduct – Zero Tolerance for Abuse. Naamaya maintains a respectful, harassment-free travel environment. Abusive, threatening, discriminatory, or harassing behavior toward guides, drivers, Suppliers, staff, local residents, communities, or hosts, or fellow travelers is strictly prohibited, including verbal, physical, or online conduct. Naamaya may remove any Traveler for such conduct at its sole discretion, without refund, and the Traveler will be responsible for any resulting costs.
13.9. Environmental & Cultural Stewardship. You agree to respect local communities and environments, follow park regulations, refrain from removing natural or cultural artifacts, comply with drone and image-use restrictions, and observe wildlife at safe distances. Fines or penalties for violations are solely your responsibility.
13.10. Medical Disclosure & Fitness to Travel. You must disclose relevant medical conditions or mobility limitations during registration. For certain itineraries, or at Naamaya’s reasonable request, medical clearance and/or completion of a medical release may be required as a condition of participation. Failure to provide adequate clearance may result in denial of participation for safety reasons, without refund of non-recoverable costs.
13.11. Age Restrictions & On-Trip Participation Decisions. Some activities, vehicles, or accommodations have minimum or maximum age limits imposed by Suppliers or local law. Parents or guardians are solely responsible for supervising minors and for compliance with all age-related restrictions. In addition, Naamaya and/or Suppliers may, in their reasonable discretion, deny or discontinue a Traveler’s participation in any activity or Trip component at any time, including on the day of operation, if participation is deemed unsafe, medically inadvisable, inappropriate due to age limits or the Traveler’s condition, or otherwise not feasible. No refunds will be provided for non-recoverable costs in such cases; any additional costs to continue the Trip or to arrange alternatives are the Traveler’s responsibility.
13.12. Participation Acknowledgment & Personal Responsibility. By choosing to travel and to participate in included or optional activities, you acknowledge and agree that you are solely responsible for your own decisions, safety, health, conduct, and property, and you will exercise prudent judgment and follow all instructions and local laws. To the maximum extent permitted by law, Naamaya is not responsible for any loss, injury, damage, or expense arising from risks inherent to travel or from your acts or omissions, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct. If you deviate from the published itinerary, disregard guidance, or participate while impaired, you assume all related risks and costs.
13.13. Accessibility & Special Needs. You must disclose at registration any physical, medical, mobility, sensory, or cognitive limitations, and any accessibility needs. We will assess feasibility and advise alternatives where possible. Many destinations, vehicles, boats, trains, attractions, sidewalks, and hotels do not meet U.S. or EU accessibility standards, and accessibility laws from your home country generally do not apply. Naamaya and Suppliers are not obligated to provide personal care or constant supervision. Additional equipment, adapted rooms or vehicles, or attendant services are subject to availability and are at the Traveler’s expense.
13.14. Minimum Mobility & Self-Sufficiency. Participation requires basic mobility and self-sufficiency appropriate to the itinerary. Certain activities and sites involve height, weight, or age restrictions, stairs without elevators, steep paths, or narrow gangways. Where an operator imposes limits, those limits govern and may result in denial of participation without refund of non-recoverable costs.
13.15. Pregnancy & Carrier/Operator Restrictions. Pregnancy must be disclosed at registration. For safety reasons, expedition-style cruises and some small-vessel or remote-region programs do not accept Travelers who will be at or beyond 13 weeks of pregnancy by embarkation, and other Suppliers may impose earlier or different cut-offs and require medical clearance. Carriers or Operators may deny boarding or participation if, in their judgment, conditions are unsafe. Naamaya is not liable for such decisions; any additional costs to continue travel or return home are the Traveler’s responsibility. Always consult your physician before travel.
13.16. Destination Safety – No Warranties; Your Duty to Review Advisories. Conditions in some destinations may be unstable or involve elevated risks. Naamaya makes no representations or warranties that any destination is safe or that travel advisories will not change. You are solely responsible for reviewing and monitoring official government advisories and for making your own informed decision to travel. By proceeding, you acknowledge and accept these risks and agree that Naamaya is not liable for losses arising from such conditions, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct.
14. Passports, Visas & Entry Requirements (Traveler’s Sole Responsibility)
14.1. Passport Validity. A passport valid for at least six months after return is required.
14.2. Traveler’s Duty. You are solely responsible for obtaining all visas, permits, and entry or transit approvals for each destination and transit point within the required timelines.
14.3. Guidance vs. Responsibility. Naamaya may share general guidance, but final responsibility rests with you. The company is not liable for denied boarding, refusal of entry, or costs arising from documentation issues or government policies.
14.4. Examples for U.S. and Canadian passports, subject to change: China – visa required in advance; Sri Lanka – ETA prior to travel; Myanmar – e-Visa; Vietnam – e-Visa; India – e-Visa; Australia – ETA or visa; Indonesia – Visa on Arrival / e-VOA for eligible nationalities; Bhutan – visa pre-arranged via authorized operator or authority; Cuba – Tourist Card/e-Visa, and for U.S. citizens travel must fall under an authorized OFAC category.
14.5. Keep Current. Requirements can change at any time. Check official government sources and carriers before booking and again prior to departure. Travelers of other nationalities may require different documentation even where U.S. or Canadian citizens do not.
15. Health, Vaccinations & Medical Care
15.1. Pre-Travel Medical Advice. Consult your physician and/or an appropriate travel-medicine clinic at least one month before departure regarding vaccinations, prophylaxis, and medical advice. Naamaya does not provide medical advice.
15.2. Medications & Costs. You are responsible for carrying personal medications, preferably in original packaging and with backups where appropriate, and for all costs of medical treatment, evacuation, or repatriation.
15.3. Public-Health Protocols & Changes Without Notice. Communicable-disease risks and public-health protocols may require screening, testing, vaccination documentation, quarantine or isolation, use of masks or PPE, or changes to services. Requirements may change at any time and without prior notice, including during the Trip. You are responsible for staying up to date and complying with current requirements. Associated costs are borne by the Traveler. Failure to comply may result in denied service without refund.
15.4. Remote Locations, Limited Services & Time to Care. While traveling in remote or developing locations, services such as telephones, medical assistance, evacuation, and ground, air, or water transportation may be unavailable, delayed, or provided at a different or lower standard than in your home country. Hospitals meeting reasonable or international standards may be located far from the itinerary, and reaching them can take significant time; air or ground evacuation may be delayed or unavailable. You acknowledge and accept these conditions and associated risks.
15.5. Independent Medical Providers; No Warranty. Naamaya makes no representations or warranties regarding the availability, quality, or suitability of medical care at any destination. Any first aid or medical treatment during a Trip is rendered by independent, locally authorized medical service providers (“MSPs”), acting in their own professional judgment and not as employees, agents, or representatives of Naamaya. MSPs and other independent contractors have no authority to bind Naamaya. To the maximum extent permitted by law, Naamaya is not responsible or liable for any act, omission, diagnosis, treatment, or failure to treat by any MSP or independent contractor.
15.6. Medical Waiver, Release & Indemnity. You assume all risks associated with illness, including communicable and infectious diseases, injury, or death arising from the circumstances described in Sections 13 and 19 and, to the maximum extent permitted by law, you waive, release, and agree to hold harmless Naamaya from and against any liability in connection therewith, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct. You agree to defend and indemnify Naamaya from claims, costs, expenses, and reasonable attorneys’ fees arising out of or relating to medical care provided by MSPs, including claims arising from negligent rescue operations or procedures undertaken by third parties. This clause survives the Trip.
15.7. No Vetting of Medical Providers; Local Standards Apply. Naamaya does not investigate or certify the background, licensing, training, or qualifications of any local medical service provider to whom you may be referred or who may provide first aid or treatment during the Trip. Care is provided under the local facility’s limited resources and standards, which may be below those in your home country. Naamaya makes no warranty regarding the quality or suitability of such care and has no control over MSP decisions.
15.8. Limits of Medical Facilities; Costs & Evacuation. Medical facilities, medications, diagnostics, and evacuation assets may be scarce, delayed, or unavailable; reaching appropriate care may take significant time. All related costs, including medical transport or evacuation and additional accommodation for you or companions, are the Traveler’s responsibility.
16. Insurance (Mandatory)
16.1. Comprehensive Coverage. You must obtain comprehensive travel insurance from the time of booking, covering at minimum: medical care, hospitalization and evacuation, repatriation, trip cancellation or interruption, baggage loss or delay, and travel delays.
16.2. Adventure/Extreme Activities. If your Trip includes, or you opt for, activities such as trekking, rafting, horseback riding, cycling, ATVs, zip-lining, diving, mountaineering, or similar, you must ensure your policy covers these activities. Definitions vary by insurer; confirm coverage directly.
16.3. Baggage & Personal Effects Insurance. You are solely responsible for insuring your baggage and personal effects. Naamaya is not liable for loss, theft, misplacement, or damage to baggage or personal property, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct. Claims must be made directly to the relevant carrier, hotel, or service provider. We strongly recommend all-risk personal effects coverage with adequate per-item limits for high-value items and careful review of limits, deductibles, and exclusions.
16.4. Proof of Insurance. Naamaya may request proof of adequate insurance as a condition of participation.
16.5. Rescue, Evacuation & Emergency Costs. Search-and-rescue, medical evacuation, emergency transportation, and related expenses, including private vehicles, helicopters, air ambulances, and additional accommodation, are the Traveler’s sole responsibility. Naamaya may assist with coordination where possible, but is not the provider and bears no liability for such costs.
16.6. No Right of Subrogation. Your policy should waive subrogation rights against Naamaya and its representatives.
17. Adventure & “Extreme” Activities – Assumption of Risk
17.1. Voluntary Participation. Participation in adventure or “extreme” activities is voluntary and at your sole risk. Naamaya does not compel participation.
17.2. No Liability for Activities. Naamaya is not liable for injuries, death, loss, or damage arising from participation in such activities, whether organized by a Supplier or chosen independently, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct.
17.3. Inherent Risks of Activities. If you participate in optional or included activities that carry inherent risk, such as animal encounters or riding, scuba diving, snorkeling, boating, hot-air ballooning, helicopter flights, zip-lining, hiking, high-altitude treks, climbing, quad-biking or ATVs, parasailing, parachuting, kayaking, white-water rafting, jet-boat rides, snowmobiling, primate tracking, and similar activities, you understand and accept the inherent risks of serious illness, injury, or death, whether foreseen or unforeseen, and assume full responsibility for your own safety.
17.4. Release, Covenant Not to Sue & Indemnity (Activities). To the maximum extent permitted by law, you: (a) release and forever discharge Naamaya from any and all claims, demands, causes of action, damages, losses, costs, or liabilities arising out of or related to your participation in the activities described above, including transportation to or from the activity site, and including property damage, cancellation for any reason, illness, negligent rescue operations or procedures, personal injury, or death; (b) covenant not to sue Naamaya regarding such matters; and (c) agree to defend, indemnify, and hold Naamaya harmless from claims brought by third parties arising from your participation in such activities, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct. This clause survives the Trip and is in addition to any Supplier or Operator waivers you sign.
17.5. Independent Operators & Equipment. Many activities are provided by independent operators who are not employees or agents of Naamaya. They alone control their staff, equipment, and safety procedures. Naamaya makes no representations or warranties about the quality or suitability of equipment or instruction. You agree to use all provided safety gear as instructed and to follow all operator rules. Naamaya is not responsible for operator acts or omissions or equipment failure, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct.
17.6. Insurance Requirement. You must maintain insurance that specifically covers the activities you elect to undertake. Verify activity coverage, limits, and exclusions with your insurer before travel.
17.7. Fitness to Participate; Right to Refuse/Stop. Naamaya and/or Operators may, in their reasonable discretion, deny or discontinue a Traveler’s participation in any activity if participation is deemed unsafe, medically inadvisable, inappropriate due to age limits or the Traveler’s condition, or otherwise not feasible. No refunds will be provided for non-recoverable costs in such cases; any additional costs to continue the Trip or to arrange alternatives are the Traveler’s responsibility.
17.8. Third-Party Claims; Selection of Counsel. Your obligations to defend, indemnify, and hold Naamaya harmless under 17.4 include claims brought by third parties, including co-travelers, arising out of your participation in activities. Upon notice of a claim, Naamaya may, at its option, select defense counsel of its choosing; you agree to cooperate fully and to be responsible for defense costs and any resulting judgment or settlement, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct.
17.9. Transportation To/From Activities; Inherent Risks Unchanged. Transportation to or from activity sites, including by 4×4, small aircraft, helicopters, boats, horses, or animals, is part of the overall activity environment and carries its own risks. Your releases and assumptions of risk apply equally to such transport segments and to negligent rescue operations or procedures by third parties.
18. Itinerary, Timings & On-Trip Changes
18.1. Flexibility. Itineraries may change due to weather, road or site closures, wildlife conditions, transportation delays, flight changes or cancellations, or other operational reasons.
18.2. Local Judgment. On-site representatives, including the guide, driver, or local office, may alter the schedule, including omitting sites, to maintain safety and feasibility.
18.3. Realistic Expectations. In developing regions, travel times can be long, roads may be winding or unpaved, and standards can vary. Delays do not constitute a failure to deliver contracted services.
18.4. Seatbelts. You must wear seatbelts when provided.
18.5. Independent Driving. Where self-drive is included, you must carry a valid national license and any required international driving permit, including a special permit for Japan where applicable. Fines, damages, or violations are your responsibility.
18.6. Developing Regions, Local Standards & Infrastructure. Many Naamaya trips operate in remote or developing regions. By booking such services, Travelers acknowledge and accept that: roads may be unpaved, winding, steep, or poorly lit; utilities and facilities may be intermittent or limited; local regulations and standards may differ from or be less stringent than those in your home country; insects, wildlife, humidity, dust, and ambient noise are common and not defects in service; and service levels, English proficiency, menu variety, credit-card acceptance, and ATM availability may be limited in rural or remote areas. These circumstances are characteristic of the destination and do not entitle Travelers to refunds or compensation. Where additional costs arise, such as re-routing, private transfers, or extra nights, they are the Traveler’s responsibility.
19. Accommodations & Rooming
19.1. Check-In/Out. Standard check-in is from 14:00 and check-out is before 11:00, unless stated otherwise by the hotel. Early check-in and late check-out are not included, are subject to availability, and may require payment of an additional night or surcharge.
19.2. Standards & Substitutions. Hotel standards vary globally and may not align with Western norms. If a listed hotel cannot confirm due to overbooking or other reasons, a hotel of similar standard may be substituted, potentially outside the immediate area, in order to preserve itinerary flow. Even after you receive the hotel list and room allocation, availability may limit specific preferences, such as bed type, connecting or adjoining rooms, view, floor, or proximity. Such requests are relayed to hotels but cannot be guaranteed. Different hotels may vary in style and standards, and substitutions may occur to best match the Trip’s logistics and your needs.
19.3. Best Available. In remote or developing areas, “best available” may still be basic, with limited English, simple meals, or intermittent utilities. Booking such trips acknowledges acceptance of these conditions.
19.4. Special Requests. Bedding types, adjacent or connecting rooms, views, high or low floors, accessibility features, and other requests are not guaranteed, though we will relay them to the hotels. Any confirmations are at the hotel’s sole discretion at check-in.
19.5. Child/Family Policy. Child pricing, occupancy rules, extra beds, sofas, cribs, connecting rooms, and family rooming configurations are governed by each hotel’s policy and local law. Cribs and extra beds are subject to availability and may incur surcharges payable by the Traveler. Safety standards, including bunk beds, balconies, and pools, may differ from those in your home country.
20. Meals & Dietary Needs
Included meals are specified in your itinerary and are typically fixed menus. Beverages and additional dishes are at your expense unless stated otherwise. Early activities may require boxed breakfasts.
Vegetarian, vegan, and allergy-related requests should be made at registration. Availability and variety may be limited; Naamaya cannot guarantee provision or prevent cross-contamination.
In most destinations there are no kosher restaurants; meals for observant Travelers will generally be vegetarian without certification, and fish may be requested where feasible but is not guaranteed.
While we and our Suppliers will make reasonable efforts to relay dietary needs, we cannot guarantee allergen-free environments or the absence of cross-contamination. Travelers with severe allergies must travel with appropriate medication, such as epinephrine auto-injectors, and assume full responsibility for managing their condition.
21. Transportation & Transfers
21.1. Touring Vehicle & Driver Availability. A private vehicle and driver, or shared touring as specified, are provided for the included touring in your itinerary only, subject to local laws and driver-hour limits. Vehicles are not at disposal 24/7 and are not provided for personal use during free time unless expressly stated in writing. Any extra use, including after-hours, additional mileage, or extra stops, is subject to availability and additional cost. Seatbelts must be worn where available; you must follow all driver or guide instructions and local regulations.
21.2. Flight/Schedule Deviations & Private Transfers. Travelers who deviate from the group flights or published schedule, including different arrival or departure times, airports, or carriers, are not entitled to group transfers or refunds for unused transfers. Upon request, Naamaya can arrange additional or private transfers at the Traveler’s expense, including waiting-time charges, night surcharges, tolls, and parking. If you miss a scheduled transfer due to a delay or change in your plans, re-arrangements are subject to availability and any extra costs are payable by you.
21.3. Baggage – Allowances, Fees & Responsibility. Airline baggage rules apply at all times. Not all airfares include checked baggage. Your flight confirmation will state the allowance known at the time of ticketing; carriers may change allowances and fees at their discretion. Excess, overweight, or extra-bag fees, including sports equipment or special items, are payable by the Traveler at check-in or at the gate and are not included in Trip pricing. Cabin-baggage size and weight limits, lithium-battery restrictions, and hazardous-materials rules apply. Naamaya is not responsible for loss, delay, or damage to baggage; claims must be made directly to the carrier. See also Sections 21.5-21.9 and Section 11.
21.4. Delays & Missed Connections. Naamaya is not liable for delays caused by carriers, weather, strikes, traffic, or government actions, nor for missed connections or resulting lost services. Additional costs, such as extra hotel nights, private transfers, re-ticketing, or fare differences, are the Traveler’s responsibility, though we will assist where possible.
21.5. Valuables, Personal Property & Baggage. Travelers are solely responsible at all times for supervising and insuring their personal property, including cash, jewelry, electronics, passports or IDs, tickets, and prescription medication. Naamaya is not a bailee and accepts no custody of personal property. To the maximum extent permitted by law, Naamaya is not liable for loss, theft, misplacement, or damage to property, whether in vehicles, aircraft, trains, boats, hotels, restaurants, airports, stations, attractions, during transfers, porterage, or activities, attended or unattended, except to the extent directly caused by Naamaya’s gross negligence or willful misconduct. Use in-room or front-desk safes where available; do not leave property unattended; keep essential medication and documents in carry-on; and purchase adequate insurance.
21.6. Courtesy Services. Courtesy services provided by hotels or Suppliers, such as wake-up calls or third-party porterage, are not guaranteed. Naamaya is not liable for missed services arising from failure of such courtesies.
21.7. Baggage Handling & Porters. Baggage is handled by independent carriers and porters subject to their terms, weight and size limits, and security rules. Claims for loss, delay, or damage must be made directly with the relevant carrier, hotel, or porter service. Naamaya may assist with documentation as a courtesy only, but is not responsible for such losses. Fragile, valuable, or irreplaceable items should not be checked or sent with porters. Normal wear and tear and manufacturing defects are not compensable.
21.8. Left-Behind / Recovered Items. Naamaya and Suppliers have no obligation to locate, store, or forward items left behind or lost during travel. Where feasible, we may assist as a courtesy. If an item is located and forwarding is possible, all packing, shipping or courier costs, customs duties and taxes, insurance, and risk of transit are the Traveler’s responsibility. Naamaya is not liable for items lost or damaged in retrieval or shipment.
21.9. Rental or Loaned Equipment. Where equipment, such as bikes, snorkeling or diving gear, ski or snow gear, cameras, GPS devices, or radios, is rented or loaned from third parties, the Traveler is directly liable for loss, theft, breakage, damage, late return, cleaning, and replacement fees under the provider’s terms.
22. Flights & Carriers
Airlines may alter schedules, routes, aircraft, and operations with little or no notice. Such changes may affect the Trip length and/or itinerary.
If you cancel due to such airline changes, standard cancellation fees apply unless airline rules provide otherwise.
Security and fuel surcharges may be imposed by airlines and authorities and are payable by the Traveler if not included at ticketing.
You are responsible for reconfirming flight times, online check-in, and complying with carrier requirements, including IDs, visa-related systems, and API data.
Natural phenomena and weather conditions, such as mountain views, wildlife sightings, northern lights, or water clarity, are inherently unpredictable and cannot be guaranteed. Lack of visibility, wildlife sightings, or adverse weather does not constitute failure to deliver services.
23. Practical Destination Notes (Guidance)
Climate & Seasons. Weather patterns, including El Niño and La Niña effects, can be unpredictable; rain may occur even in “dry seasons.” Itineraries may adjust accordingly.
Road Conditions. In many Naamaya destinations, Travelers should expect long drives, variable road conditions, and travel times that may differ from estimates.
Standards. Lodging, service, and infrastructure standards may vary from Western norms; this is part of the destination’s character.
Flexibility & Attitude. Patience and good humor help ensure a rewarding experience when unexpected changes occur.
24. Liability, Limitations & Indemnification
To the maximum extent permitted by law, Naamaya’s aggregate liability for any claim relating to a Trip shall not exceed the amount actually paid to Naamaya for the affected portion of services.
Naamaya shall not be liable for indirect, incidental, consequential, punitive, or special damages, including lost profits or opportunities.
You agree to indemnify and hold harmless Naamaya, its officers, employees, and representatives from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your acts, omissions, breach of these Terms, violation of laws, or infringement of third-party rights.
Naamaya is not liable for acts or omissions of Suppliers or for events beyond our control, including Force Majeure.
25. Accuracy, Errors & Omissions
We endeavor to ensure accuracy; however, descriptions, photos, and inclusions may change. Obvious errors or omissions are not binding and may be corrected without liability.
Special requests are not guaranteed unless confirmed in writing as included.
26. Documentation & Final Travel Pack
Approximately one week prior to departure, Travelers typically receive final documents including key contacts, tips, confirmations for hotels and domestic flights, and the final itinerary in English. Technical versions may include Supplier codes and may not be a word-for-word translation. Where available, translations may be provided for convenience.
You must review all documents promptly and notify Naamaya of any discrepancy.
It is the Traveler’s responsibility to verify the accuracy of all final documents, including names exactly as per passport, dates, flight details, room types, and special requests. Changes requested after document issuance may incur fees and are subject to availability.
27. Privacy & Data Protection
Naamaya respects your privacy. We collect and process personal data to provide services, manage bookings, improve operations, and communicate with you, including service updates and marketing if consented.
Typical data includes name, contact details, passport or visa information, preferences, itinerary details, and payment confirmations. We do not store full card numbers.
We share data with Suppliers solely as needed to fulfill bookings; with processors such as payment providers, CRMs, and emailing services; and as required by law or to protect legitimate interests. We do not sell personal data.
We implement reasonable technical and organizational measures, including encryption where appropriate and restricted access, to protect data.
Subject to law, you may request access, correction, deletion, or opt out of marketing. We retain data as needed to provide services and comply with legal obligations. We may update this policy periodically; material changes will be posted with an updated date.
28. Marketing, Images & Testimonials
28.1. Consent by Registration & Participation. By registering for and/or participating in a Trip, you consent to Naamaya capturing and using your image, likeness, voice, and testimonials created during the Trip or later provided by you, for Naamaya’s promotional purposes including our website, social media, newsletters, and print. You grant Naamaya a non-exclusive, worldwide, royalty-free license to use such content without additional compensation.
28.2. Right to Withdraw (Prospective). You may withdraw consent at any time for future uses by contacting us per Section 33. Withdrawal will not affect uses already made or materials already printed or distributed, but we will use reasonable efforts to remove digital content under Naamaya’s control going forward.
28.3. Trip-Level Opt-Out. If you prefer not to be photographed or filmed, please inform your guide at the start of the Trip and avoid stepping into group photos or organized shoots. We will do our best to accommodate practical requests.
28.4. Minors (Consent by Parent/Guardian; Consent by Submission). For Travelers under 18, consent must be provided by a parent or guardian. When a parent or guardian supplies to Naamaya any photos, video, or testimonials of or featuring the minor, that act constitutes the parent or guardian’s representation that they have authority to grant, and they hereby grant, the consents and licenses set out in 28.1 for those materials. Parents or guardians may withdraw consent for future uses at any time per 28.2. Naamaya will not knowingly publish identifying information for minors without explicit permission and will not sell minors’ images to third parties.
28.5. Testimonials. You are not obligated to provide testimonials. If you choose to share feedback or quotes with us, you grant Naamaya the right to edit for length or clarity, without changing the meaning, and to translate as needed, under the license in 28.1.
28.6. No Sale of Personal Images. Naamaya will not sell your personal images to third parties.
29. Complaints, Notice-and-Cure & Dispute Resolution
29.1. We’re here to help. If anything is not as expected, please contact the local representative or guide immediately. If unresolved, contact Naamaya right away so we can assist in real time.
29.2. Notice Within 30 Days. If a matter remains unresolved, you must notify Naamaya in writing within 30 days of your Trip’s end date. We will review in good faith and make reasonable efforts to resolve.
29.3. Online Reviews, Non-Disparagement & Notice-and-Cure. Before posting negative or disparaging content online, including on social networks, review sites, blogs, or forums, or initiating legal action, you agree to: (a) provide Naamaya written notice of the issue within the timeframe in 29.2; (b) allow Naamaya a reasonable opportunity to investigate and cure, no less than 30 days from notice unless a shorter period is required by law; and (c) participate in good-faith discussions or mediation if elected under 29.4. During the notice or cure window and while any mediation is pending, you will refrain from publishing negative or disparaging online content about Naamaya, our staff, or our Suppliers regarding the dispute. Nothing in this clause prevents you from making truthful statements made in good faith and protected by applicable law, submitting complaints to regulators or law enforcement, or leaving reviews after completion of the notice-and-cure process, provided the statements are not false or misleading.
29.4. Mediation (at Naamaya’s Option). Any dispute may, at Naamaya’s sole discretion, be referred first to mediation. If mediation is chosen, it may be conducted in person or virtually, at a location agreed by the parties or as directed by the mediator. The choice of mediation venue is for convenience only and does not affect governing law or court jurisdiction under 29.5.
29.5. Governing Law & Courts. These Terms and any dispute or claim arising out of or in connection with them or the Trip are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. The competent courts of Tiberias, Israel have exclusive jurisdiction and venue. To the maximum extent permitted by law, you waive any objection to venue or forum, including based on forum non conveniens.
29.6. Limitation Period. Any claim against Naamaya must be filed within 6 months of the Trip’s end date; thereafter, claims are barred.
29.7. No Class/Representative Actions. To the maximum extent permitted by law, you waive the right to participate in class, collective, or representative actions against Naamaya.
30. Communications & Electronic Signatures
You consent to receive communications electronically. Electronic signatures and acknowledgments have the same legal effect as handwritten signatures where permitted by law.
31. General Provisions (Boilerplate)
31.1. Entire Agreement; Order of Precedence. These Terms, together with your Digital Quote or itinerary and booking confirmation, constitute the entire agreement between you and Naamaya and supersede all prior understandings about the Trip. If there is any inconsistency, the itinerary or Digital Quote and booking confirmation govern the services purchased; these Terms govern all other matters.
31.2. Amendments; Waiver. Changes to these Terms must be in writing and issued by Naamaya. A failure or delay in enforcing any provision is not a waiver.
31.3. Severability. If any provision is held invalid or unenforceable, the remainder remains in full force and effect.
31.4. Assignment. You may not assign or transfer your booking or rights under these Terms without Naamaya’s prior written consent. Naamaya may assign or delegate to affiliates or service providers.
31.5. Governing Language. These Terms are drafted in English and may be translated for convenience. If a translation conflicts with the English version, the English version controls.

By booking or participating in a Trip arranged by Naamaya, you confirm that you have read, understood, and agreed to these Terms & Conditions, including the mandatory insurance requirement, the Notice-and-Cure process in Section 7, the Force Majeure allocation of costs in Sections 9 and 24, the Supplier and independent-contractor provisions in Section 8, and the governing law and jurisdiction clauses in Sections 7 and 28.
